Freight forwarding services and transport services are exclusively subject to the “General Austrian Forwarder’s Terms” (AÖSP) and the “Terms and Conditions of carriers” (TCC), in most recent versions, as published in the Viennese gazette. Transport costs concerning national and international long-distance traffic / road freight transport, the CMR (BGBL. 138/1961), is agreed upon by the AÖSP.
Like rail freight, regular freight is due immediately without deductions.
We refer to the EU Late Payment Directive 2011/7 / EU on and charge you as of 30 days starting from the invoice date including additional collection costs. In case of doubt, the date of delivery is the date of contract completion
Jurisdiction for all cases is Kitzbühel. As a choice of jurisdiction under Art. 31.1 CMR one can chose between Vienna, Amsterdam and Munich, to be agreed upon.
Loading and delivery deadlines according to the Excerpt from the General Terms and Conditions of carriers (TCC): “Section 12 loading and delivery deadlines”. If an agreed upon load in or delivery deadline has been exceeded and/or delayed by circumstances created or influenced by the client (noting that sender and receiver are the responsibility of the client) client has to pay the hourly rate according to negotiated transportation fee in addition to any arising costs (eg empty trips, etc., dwell times) and replacing any damages caused by the delay.
